My Spouse Lives in Another State – How Can I Get a Divorce?

You can file for divorce in a state where you and your spouse meet the residency requirements. The filing spouse must reside in Missouri for at least 90 days.

Getting divorced is almost always complicated. The situation is even more challenging when your spouse no longer lives in the same state. However, even if your spouse has moved, you can still get a divorce. The Betz Law Firm can provide the legal assistance you need to navigate this challenging time in your life.

Understanding the Residency Requirements

You are not required to return to the state that issued your marriage license. You can file in a state where you and your spouse meet the residency requirements. Before a judge hears your case, you or your spouse must meet these requirements. Each state has different requirements regarding the length of time one must have lived there before filing a divorce.

You must provide evidence that you or your spouse fulfill the requirements. If one of you recently moved to a new state, you will likely have to wait until you can meet the residency requirements. The filing spouse must reside in Missouri for at least 90 days.

Choice of Where You File

Whether you decide to divorce in your home state or your spouse’s newer state depends on various factors. If your case is relatively straightforward and you agree on the terms, the state where you file may not matter. However, specific states treat some issues differently, such as alimony, child custody, child support, and division of property. Therefore, before filing, check to see which state you may be eligible to file that has laws favorable in your case.
